Y si bien sucede, la tutela no es muy com\u00fan dentro del \u00e1mbito del cuidado de crianza.<\/p>\n<p>Sin embargo, es algo que creo que mucha gente, al menos en sus mentes, intercambia con \u201cAdopci\u00f3n\u201d. Pero si bien hay algunas similitudes y puedo entender totalmente la confusi\u00f3n, definitivamente son bestias diferentes.<\/p>\n<p>As\u00ed que d\u00e9jame explicarte un poco sobre la tutela. Una tutela legaliza la relaci\u00f3n entre un adulto que no es el padre biol\u00f3gico y un ni\u00f1o; se diferencia de la adopci\u00f3n en que no rompe la relaci\u00f3n jur\u00eddica entre los padres biol\u00f3gicos y el ni\u00f1o. En la adopci\u00f3n, la relaci\u00f3n y los derechos cambian formal y permanentemente. Los adultos que adoptan a un menor de edad se convierten en padres legales y asumen todas las responsabilidades y derechos de la paternidad; cualquier padre biol\u00f3gico vivo deja de tener derechos y obligaciones parentales.<\/p>\n<p>En una tutela, el padre biol\u00f3gico mantiene cierto control y brinda apoyo financiero; y el alcance de los padres biol\u00f3gicos se extiende hasta el punto de que pueden (con la aprobaci\u00f3n del tribunal) poner fin a la tutela. Sin embargo, a menudo las tutelas permanecen vigentes hasta que el ni\u00f1o cumple 18 a\u00f1os; fallece un ni\u00f1o; o el tribunal decide que la tutela ya no es necesaria.<\/p>\n<p>Un juez es el \u00fanico que puede nombrar la tutela; Los padres biol\u00f3gicos no pueden \u201cceder\u201d la tutela a otro adulto. Sin embargo, pueden dar su consentimiento para una tutela. Un juez a menudo tendr\u00e1 en cuenta los deseos de los padres al otorgar una tutela, pero tomar\u00e1 la determinaci\u00f3n final bas\u00e1ndose en el inter\u00e9s superior del ni\u00f1o.<\/p>\n<p>Entonces, llegados a este punto, quiz\u00e1s se pregunte qu\u00e9 ni\u00f1os necesitar\u00edan siquiera una tutela. Los ni\u00f1os que podr\u00edan necesitar una tutela pueden incluir, entre otros, aquellos que se encuentren en las siguientes situaciones:<\/p>\n<ul>\n<li>Uno o ambos padres biol\u00f3gicos est\u00e1n en la c\u00e1rcel o prisi\u00f3n;<\/li>\n<li>Uno o ambos padres biol\u00f3gicos tienen delitos de abuso infantil y\/o violencia dom\u00e9stica;<\/li>\n<li>Uno o ambos padres biol\u00f3gicos est\u00e1n en rehabilitaci\u00f3n de alcohol o drogas;<\/li>\n<li>Uno o ambos padres biol\u00f3gicos no pueden cuidar a los ni\u00f1os debido a problemas de salud mental.<\/li>\n<\/ul>\n<p>Ahora s\u00e9 lo que est\u00e1s pensando: parece que muchos de los ni\u00f1os colocados en hogares de acogida. Y estar\u00edas en lo cierto. Pero en el cuidado de crianza, un ni\u00f1o ha sido separado de sus padres biol\u00f3gicos y est\u00e1 bajo la tutela del tribunal; el tribunal toma las decisiones cr\u00edticas para el ni\u00f1o.
